1. General
These Terms of Use apply to the use of the SuperQuest service (the ‘Service’) provided by Javanainen Consulting Oy / J&Co Digital (J&Co).
SuperQuest is a digital service that enables companies and organisations to create and publish interactive content, forms, surveys, selectors, games and other digital features on websites and other digital channels.
By using the service, the user (the User) agrees to comply with these terms and conditions.
A separate service or licence agreement may also apply to the customer relationship between corporate customers using SuperQuest and J&Co. In the event of any conflict between a separate agreement and these general terms and conditions of use, the terms of the separate agreement shall take precedence.
2. Using the service
The user undertakes to use the Service in accordance with the law, good practice and these terms and conditions.
The service must not be used to publish or transmit content that:
- is unlawful
- infringes a third party’s copyright, trade mark, privacy or other rights
- is misleading, offensive, discriminatory or otherwise contrary to good practice
- contains malware or other content that jeopardises the operation of the Service or other systems.
The user must not attempt to gain unauthorised access to the Service’s systems, interfere with the operation of the Service, circumvent the Service’s technical restrictions, or use the Service in a manner that may cause an unreasonable load or inconvenience to the Service or other users.
3. User account
Some of SuperQuest’s features require you to create a user account.
The user is responsible for the accuracy of the information they provide and for the proper safekeeping of their usernames and other login details.
Users must not allow unauthorised persons to use their personal usernames.
The user must notify J&Co without undue delay if they suspect that their user account or login details have been accessed without authorisation.
4. User content and responsibility for actions
SuperQuest enables Users to add their own content, materials and data to the Service.
The user or the organisation they represent retains the rights to the material they upload to the Service.
The user is responsible for ensuring that they hold the necessary rights to use and publish the content, images, text, personal data and other material they upload to the Service.
The user and the organisation they represent are responsible for the content of the implementations they have built and published on SuperQuest, as well as for their compliance with the law.
5. Artificial intelligence features
SuperQuest may include features that utilise artificial intelligence, enabling the User, for example, to create, edit or process content.
Content generated by artificial intelligence may contain errors, inaccuracies or content that is otherwise unsuitable.
The user is responsible for checking content generated by artificial intelligence before using or publishing it.
J&Co does not guarantee the accuracy, completeness or suitability of content generated by artificial intelligence for the User’s intended purpose.
6. Intellectual property rights
All intellectual property rights relating to the SuperQuest service, its software, structure, features, modules, technology, documentation, as well as any changes and further developments thereof, are owned by J&Co or their respective rights holders.
Use of the service does not confer any ownership or other intellectual property rights in the SuperQuest service upon the User.
The user is granted only the right to use the Service in accordance with the valid licence and these terms of use.
7. Personal data and data protection
J&Co processes personal data in accordance with applicable data protection legislation and SuperQuest’s privacy policy.
When a company or organisation uses SuperQuest to collect personal data from users of its own website or other digital channels, that company or organisation acts, as a general rule, as the data controller for the personal data being collected.
In such cases, J&Co acts as a data processor on behalf of the data controller in accordance with the agreed data processing terms.
With SuperQuest, the organisation publishing the implementation is responsible for ensuring ensuring that there is an appropriate legal basis for the collection and processing of personal data and that users are provided with the information required by applicable data protection legislation regarding the processing of personal data.

8. Service availability and changes
J&Co endeavours to ensure that the Service is available at all times and to ensure that it functions properly.
However, the service may be subject to interruptions, for example due to maintenance, updates, technical faults or reasons beyond J&Co’s control.
J&Co reserves the right to develop the Service and to modify its features, technical implementation and user interface.
J&Co may, if necessary, suspend access to the Service or part thereof whilst carrying out maintenance, updates, security measures or other necessary actions.
9. Limitation of liability
J&Co does not guarantee that the Service will operate without interruption or error in all circumstances.
J&Co shall not be liable for any damage resulting from the actions of the User or a third party, the incorrect use of the Service, content published by the User, or any cause beyond J&Co’s control.
J&Co shall not be liable for any consequential or indirect damages, such as loss of profit, loss of turnover, business interruption or any other similar financial loss, unless otherwise required by mandatory legislation.
In the case of business customers, any further limitations on liability may be agreed in a separate service or licence agreement.
10. Restrictions on the use of the service
J&Co reserves the right to restrict or suspend a User’s access to the Service if:
- The user is in material breach of these terms and conditions
- The service is being used unlawfully
- Use of the Service jeopardises the security of the Service, other users or third parties
- Use of the service causes, or threatens to cause, significant technical disruption
- Overdue payments relating to the service have not been made as agreed.
Where possible, J&Co will give advance notice of any restrictions on use and provide the User with a reasonable opportunity to rectify the situation.
11. Third-party services
SuperQuest can be integrated with third-party services and systems.
J&Co accepts no responsibility for the operation, availability or terms of use of third-party services, or for the processing of personal data carried out in connection with them.
The use of third-party services is subject to the terms and conditions of the relevant service providers.
12. Amendments to the Terms of Use
J&Co may update these Terms of Use, for example, if there are changes to the Service, legislation or our business operations.
The latest version of the terms and conditions will be published on this page.
Where necessary, any material changes will be notified via the Service or by other appropriate means.
13. Governing law and disputes
These terms and conditions are governed by Finnish law.
Any disputes shall, as a matter of priority, be resolved through negotiation.
If the dispute cannot be resolved through negotiation, the matter shall be settled by the Länsi-Uusimaa District Court, unless otherwise provided for by mandatory legislation.
